This Privacy Policy (“Privacy Policy”), is an integral part of our End User License Agreement (“EULA”), and governs the processing and transfer of personal data collected or processed by pub: GoWithEasy. (“Company”, “we”, “us” or “our”) when you accessing or using our mobile application or our services, all as detailed in the applicable EULA (respectively the “App” and “Service”).

Any capitalized terms not defined herein shall have the meaning ascribed to them in the End User License Agreement.

This Privacy Policy explains what data we may collect from you, how such data may be used or shared with others, how we safeguard it and how you may exercise your rights related to your Personal Data (as defined below), among others, and where applicable, as required according to the EU General Data Protection Regulation (“GDPR”),the Brazilian General Data Protection Law (as amended by Law No. 13,853/2019) (“LGPD”), the California Consumer Privacy Act (“CCPA”) and other US states as further detailed below.

This Privacy Policy explains our data collection practices that are applicable to any users of our App or our Services (“you” or “your”).

1. DATA SETS WE COLLECT AND FOR WHAT PURPOSE:

Discover details about how we handle your personal data, including the reasons for processing and the legal basis for such processing. We also provide insights into the technical processing of both "personal" and "non-personal" data.

1.1 Non-Personal Data

Throughout your interaction with our website and Services, we may collect aggregated, non-personal non-identifiable information, which may be made available or gathered via your access to and use of the Services (“Non-Personal Data“). We are not aware of the identity of the user from which the Non-Personal Data is collected. The Non-Personal Data being collected may include your aggregated usage information and technical information transmitted by your device, such as: the type of browser or device you use, language preference, time and date stamp, country location, etc.

We may also collect from you, directly or indirectly, during your access or interaction with the website or Services, individually identifiable information, namely information that identifies an individual or may, with reasonable effort, be used to identify an individual (“Personal Data”). We do not knowingly collect or process any Personal Data constituting or revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, genetic data, biometric data, data concerning a person’s health or data concerning a person’s sex life or sexual orientation (“Special Categories of Personal Data”).

  • Contact Information:

If you voluntarily contact us, providing information such as your name, job title, company name, and email address ("Contact Information"), we use this data to respond to your inquiry. We process Contact Information based on our legitimate interest, and we may retain correspondence if legally required. The processing of Contact Information is performed based on our legitimate interest, and retention may be legally required.

  • GPS Location Information:

Access to your GPS location permissions may be required for certain features. We use this information to provide the Services and for advertising purposes. It may run in the background, showing applicable WIFI networks. Processing of this data is based on your explicit consent through in-app notifications. Processing GPS Location Information is based on your explicit consent.

  • Push Notifications:

We may store Firebase Cloud Messages token for push notifications. To stop receiving push notifications, you can disable them in your device's settings or uninstall the app. This information is processed to send push notifications to users. As the token is Non-Personal Data, it does not require a lawful basis. Processing of Push Notifications is not based on a lawful basis, as the token is Non-Personal Data.

  • In-App Payment Information:

In-app payments are subject to App Store terms and privacy policies. Registration and payment information are processed solely by the app store provider. We do not store or process any Personal Data during payments. The Payment Information is processed to perform our contract with you. The processing of Payment Information is performed to fulfill our contract with you.

  • Log Data and Unique Identifiers:

In case of errors in the App, we collect Log Data or Crash Data, including device IP address, device name, operating system version, App configuration, and usage statistics. This data is processed for our legitimate interest in protecting and optimizing the App and Services. Processing Log Data and Unique Identifiers is based on our legitimate interest.

  • List of Installed App:

When you install our App, we may collect information about your installed Apps. This data may contain identifiable information and is treated as Personal Data. We use this data to maintain, support, improve, protect, and manage our App and Services. Processing is based on your consent through in-app permissions. Processing the List of Installed Apps is based on your consent.

  • Profiling Data:

While using our App, advertisers may collect data for contextual, behavioral, and interest-based advertising. Users can reset advertising settings or opt-out through device settings. Processing of Profiling Data is based on your consent through cookie manager or similar technologies. Processing Profiling Data is based on your consent.

  • Photos and Videos:

If you use our designated feature, providing photos, images, or videos for editing, we process this data to provide Services and enable editing and animation functions. Processing is based on your consent through in-app permissions. Processing Photos and Videos is based on your consent.

  • Microphone and Audio:

For the dialer feature, permission to your microphone is required. This data is processed to provide the dialer feature and is based on your consent through in-app permissions. Processing Microphone and Audio is based on your consent.

  • Call Log and Contacts:

For the dialer feature, permissions to your call log and contacts are required. Processing is based on your consent through in-app permissions. Processing Call Log and Contacts is based on your consent.

The actual processing operations for each purpose and lawful basis may differ, including collection, storage, use, disclosure, erasure, or destruction. The transfer of personal data to third-party countries is based on the lawful basis stipulated above.

In addition, Personal Data may be used to prevent prohibited or illegal activities, fraud, misappropriation, infringements, identity theft, and misuse of the Services, as well as to protect the security or integrity of our databases and the Services. Such processing is based on our legitimate interests.

We may collect different categories of Personal Data and Non-Personal Data based on the nature of your interaction with the Services provided through the website and Platform, as detailed above. If we combine Personal Data with Non-Personal Data, the combined information will be treated as Personal Data for as long as it remains combined.

2. HOW WE GATHER YOUR INFORMATION: 

Based on the nature of your engagement with us, the information detailed above may be collected in the following ways:

3. SDK & TRACKING TECHNOLOGIES: 

In the operation of our Services and with the assistance of certain Service Providers, we employ various tracking technologies, including but not limited to "cookies," "software development kits (SDKs)," and anonymous identifiers (collectively referred to as "Tracking Technologies"). These technologies play a crucial role in enhancing and refining our Services, personalizing user experiences, monitoring the effectiveness of our activities and campaigns, and assessing the overall usage patterns of our Apps and Services.

In general, we retain the Personal Data we gather for the duration necessary to achieve the purposes outlined above, in compliance with the relevant regulations, or until you indicate your preference to opt-out, if applicable.

Other instances where we may keep your Personal Information for extended periods include: (i) compliance with legal, regulatory, tax, or accounting obligations, (ii) maintaining an accurate record of your interactions with us for potential complaint resolution or challenges, or (iii) anticipating the possibility of litigation related to your Personal Data. It's important to note that, unless required by applicable law, we are not obligated to uphold your data for a specific duration, and we reserve the right to delete it at any time and for any reason without prior notice.

5. SECURITY MEASURES:

We are dedicated to implementing robust physical, technical, and administrative security measures for our services, aiming to align with both applicable regulations and industry standards. These measures are designed to prevent unauthorized access, improper use or disclosure, unlawful destruction, or accidental loss of your information.

6. INTERNATIONAL DATA TRANSFER:

We utilize Google Cloud services, which have locations in the EU, US, and Asia. Additionally, specific processing activities may take place in Pakistan or other countries. When transferring data outside your jurisdiction, we will implement suitable measures to ensure that your Personal Data maintains an appropriate level of protection, as mandated by applicable law. Moreover, if Personal Data collected within the EU is transferred beyond the EU to a country without deemed adequate protection, such transfers will adhere to the standard contractual clauses endorsed by the European Union. 7. ELIGIBILITY AND CHILDREN PRIVACY:

The Services are not designed for use by children (the term "child" refers to an individual under the age specified by applicable law, which is under the age of 16 in the EEA and under the age of 13 in the US), and we do not knowingly process children’s information. Upon discovering that a user considered a "child" has shared information with us, we will promptly discard such information.
